By placing a bid, bidder agrees to, upon auction closing, the following stipulations and Sales Contract as posted in this listing, and as provided on this site:

  "Seller" agrees to sell and, winning bidder, a private party, "Buyer" agrees to buy the used item or items presented in this auction listing, herein known as “Equipment”.  To carry out the purposes of this agreement and in consideration of the benefits to be received by each party it is agreed as follows:

1. Price and Terms of Payment. The price of the Equipment shall be as determined through open bidding on this site, and shall be payable prior to delivery of the Equipment.  Upon bidding completion, Buyer agrees to assume all responsibility and liability of the Equipment, and hold harmless and defend the Buyer in the event of any claims, actions, or judgments resulting from the use of the Equipment.  

2. Taxes. Any tax or other governmental charge imposed on the sale of the Equipment shall be paid by Buyer.

3. Pick up only. No one will be available to help load. 

4. Risk of Loss. Risk of loss shall pass to Buyer on transfer of funds. 

5. Inspection. Buyer has inspected the Equipment through details listed, pictures provided, and questions asked and answered, and accepts the Equipment in its present condition. The Buyer has been informed of all defects in the Equipment known to Seller. (Heavily used, unknown condition, potentially contaminated with structural firefighting by-products of combustion.)

6. Warranty. The Equipment is sold in an as is condition.  Seller makes no warranty express or implied, written or oral regarding the condition of the Equipment and Seller specifically disclaims any implied warranty of merchantability or fitness for a particular purpose. Use of this item for anything beyond Novelty, Collectability, or Scrap is strictly at the buyers discretion and responsibility.

7. Applicable Law. The sales agreement between Buyer and Seller is to be construed according to the laws of the State of Washington.

8. Scope of Agreement. This agreement, along with the stipulations of sale of the auction web site, constitutes the full understanding of the parties, and no terms, conditions, understandings or agreement purporting to modify or vary the terms of this agreement shall be binding unless in writing and signed by the parties.  This agreement is effective upon auction end, between the Seller and the Buyer.

Bid Deposits: Marysville Fire District may require bid deposits to ensure fairness to all buyers.

PayMac handles all payments for Marysville Fire District.

Acceptable forms of payment are: Wire Transfer or Credit Card.
NO CASH, CHECKS, OR MONEY ORDERS WILL BE ACCEPTED!

Payment for an awarded item must be received within five (5) business days after notice of award of the winning bid.


Buyers Premium:A Buyers Premium of 10% will be added to the final sale price with a $1 minimum charge per auction for payment collections. This premium if applicable will be visible during the bidding process and added to the total bid.

All sales are final. Public Surplus will notify buyer of receipt of payment via email.

The successful bidder will be responsible for removal or pick-up of item(s) from the agency's premises. Removal must occur within ten (10) business days after notification of award of the winning bid. The notice of award, the payment receipt, and personal identification must be presented at the time of pick-up, or the Marysville Fire District will not release the item to you.

The successful bidder will be responsible for the packing, loading and/or transporting of any item(s), if necessary.
